NOTICE OF ADOPTION OF RESOLUTION

SUBJECT TO PERMISSIVE REFERENDUM

NOTICE IS HEREBY GIVEN that at a meeting held on the 13th day of July, 2023, the Town Board of the Town of Goshen, Orange County, New York, duly adopted a Resolution entitled “RESOLUTION AUTHORIZING THE SALE OF CERTAIN LANDS OWNED BY THE TOWN OF GOSHEN TO LEGOLAND NEW YORK, LLC, an abstract of which follows, which Resolution was adopted subject to a permissive referendum pursuant to Section 64(2) and Article 7 of the Town Law of the State of New York.

Abstract: The purpose and effect of said Resolution was to (1) determine that all of the following parcels of land now owned by the Town of Goshen, as shown on a Map attached to said Resolution, were no longer required for use by the Town:  Tax Map Section 11, Block 1, Lots 63, 68, and 69 (those portions of the parcels to be sold shall be referred to as the “Subject Parcels”); and (2) authorize the sale, transfer and conveyance by the Town to LEGOLAND New York, LLC, of all of the Town’s right, title and interest in and to the Subject Parcels, subject to the easements and other restrictions shown on said Map, for a purchase price of Sixty-Thousand ($60,000.00) dollars, and upon such other terms and conditions as acceptable to the Attorney for the Town as to form and consistent with this Resolution and the above-referenced SEQRA Findings Statement.

The Town has complied with all applicable requirements, and made all required determinations, under and pursuant to Town Law, New York State Environmental Quality Review Act (“SEQRA”) (6 NYCRR 617), and all other applicable laws, with respect to the proposed sale, transfer and conveyance of the Subject Parcels, including, but not limited to, the adoption of a SEQRA Findings Statement on September 11, 2017, which was reaffirmed by the Town Board on July 13, 2023.

Said Resolution shall not take effect until thirty (30) days after the date of its adoption, nor until approved by the affirmative vote of a majority of the qualified electors of the Town voting on such proposition, if within thirty (30) days after the adoption of this Resolution, there be filed with the Town Clerk of the Town a petition signed, and acknowledged or proved, or authenticated by electors of the Town qualified to vote upon a proposition to raise and expend money, in number equal to at least five per centum of the total vote cast for governor in the Town at the last general election held for the election of State officers, but which shall not be less than one hundred in a town of the first class nor less than twenty-five in a town of the second class, protesting against this Resolution and requesting that it be submitted to the qualified electors of the Town, for their approval or disapproval.

A copy of the Resolution is available for public inspection during normal business hours at the Town Clerk’s office, located at the Town Hall, 41 Webster Avenue, Goshen, New York 10924.
